  • Prosecuted appeals in the United States Courts of Appeal for the Seventh and Ninth Circuits regarding scope of Miller Act, entitlement to liability insurance proceeds where surety satisfies tort victim’s damages under a supersedes bond, and scope of economic loss doctrine under state and federal law.
  • Retained as expert witness in legal malpractice action involving alleged negligence by attorney representing prime subcontractor in disputed scope and payment dispute arising out of under-designed and delayed power plant project valued in excess of $200 million.
  • Reviewed and drafted contract documents for owners, contractors, subcontractors, subcontractors, and material supplier clients with an eye to crafting balanced and enforceable indemnification, warranty, insurance coverage, change order, payment, set off, termination and dispute resolution provisions.
  • Advised clients regarding the interplay between their contract documents and insurance policies to ensure alignment of coverages through the contracting chain and among interested parties including indemnitees, additional insureds, and loss payees.
  • Reviewed and drafted documents for troubled construction projects including forbearance, indemnity, teaming, takeover, and tender agreements.

  • Successfully prosecuted $7 million breach of contract and equitable claims against general contractor on behalf of surety and its principal involving sophisticated mechanical project at large private university; case settled through mediation with all back charges of general contractor against surety waived and significant affirmative amount paid to surety.
  • Represented issuers of subdivision performance bonds in multi-million-dollar coverage disputes in state and federal court involving issues of standing, successor liability, limitation defenses, and concurrent jurisdiction.
  • Reviewed and drafted documents for troubled construction projects including forbearance, indemnity, teaming, takeover, and tender agreements.

  • Represented owner in successful confidential mediation involving assertion of E & O claims against more than ten design professionals to recover in excess of $30 million dollars in construction cost overruns.
  • Represented prime subcontractor in $5 million breach of contract, acceleration, and mechanics lien action before the American Arbitration Association pertaining to purported late delivery of a luxury apartment building; settled matter on favorable terms for client in advance of expert discovery.
  • Defended owner and general contractor in $8 million construction defect case involving allegations of water infiltration at a commercial office building; settled matter for less than 20% of potential exposure to clients.

  • Defended owner in $1.5 million breach of contract action involving purported defective work and failure to complete punch list work; resolved matter without client paying any amount to plaintiff.
  • Successfully represented prime design build contractor in dispute involving alleged defective, incomplete and untimely work on $250 million power plant retrofit project; settled litigation with owner and installation subcontractor in advance of proceeding to expert discovery.

  • Defended insurance company in multi-million dollar MDL proceeding involving allegations of price fixing, bid rigging, and other antitrust and fraud allegations in the market for sale of commercial property and casualty policies; secured favorable settlement for client in advance of filing dispositive motions.
  • Defended insurance company in multiple class actions in state and federal courts involving allegations of fraudulent failure to disclose likelihood of premium price increases for long-term care policies; favorably settled all actions in advance of dispositive motions and trial.
  • Defended insurance company in four-week private arbitration involving allegations of improper handling of claims made against workers’ compensation policies and alleged negative impact on the pricing of the insured’s retrospective premiums; obtained arbitration award of less than 50 percent of insured’s demand.
